CONFIDENTIALITY POLICY

We, Anka Toprak Ürünleri Sanayi Ve Ticaret Anonim Şirketi, adopted the principle of ensuring confidentiality of the personal data shared by the people who visit the web site, https://ankaseramik.com.tr.

In this context, certain rules are developed to ensure confidentiality when the personal data of the site users, who are the “data subject” pursuant to this Confidentiality Policy, is processed.

DATA CONTROLLER:

Anka Toprak Ürünleri Sanayi ve Ticaret Anonim Şirketi with headquarter at Güvenevler Mahallesi Farabi Sk. No: 43 Çankaya/ANKARA (Trade Registration No. 198745, Ankara Trade Registry Office. Seğmenler Tax Office – Tax ID: and Mersis No: 0069047413600012) is the data controller, which processes the personal data of the site users – the “data subject -, pursuant to this policy.

1. DEFINITIONS

Based on this policy, following terms have the meanings assigned thereto,

SITE: The domain, https://ankaseramik.com.tr, and all sub-domains,

SERVICE: All services that are delivered through the web site, https://ankaseramik.com.tr, in ANKA TOPRAK.

LAW: The Personal Data Protection Law (Law No. 6698)

PERSONAL DATA: All documents about an identified or identifiable natural person.

USER: A natural person who visits/uses the SITE in any manner and is referred to as the “data subject” in the LAW; the personal data of this person is processed when the site is visited/used.

1. AIM AND SCOPE

This policy aims to ensure that the personal data is processed legally in line with the LAW and the secondary legislation and that the constitutional individual rights and freedoms of the USER, whose data is processed, are protected. In this context, we aim to ensure that the personal data processing activities of ANKA TOPRAK within the scope of the SITE are performed in accordance with the rules mentioned in this policy.

This policy, hereby, applies to all natural persons who visit/use the SITE.

1. COLLECTED PERSONAL DATA
1. 3.1.ANKA TOPRAK can use certain distinctive information of the USER when the SERVICE is used. This information is as follows;

• IP address
• Name and Surname
• E-mail address
• Form filling data
• User approvals
• Information about the device/operating system used by the USER to visit the site through first and third party cookies, and the data about the use of the site.

1. 3.2.The data about the use of the site is automatically collected when the SERVICE is used. Aforementioned data can include IP address of the device, type of the search engine, version of the search engine, pages visited in the site, duration of visit to these pages, date and time of access to these pages, unique device identifiers and other control data.
2. 3.3.When the SERVICE is accessed over a mobile device, ANKA TOPRAK shall collect data automatically. Although above mentioned ones are not an exhaustive list of such data, it can also include type of the mobile device, IMEI, IP address, operating system, type of the mobile internet browser, unique device identifiers and other control data.
3. 3.4.If the SERVICE is used in a mobile device, ANKA TOPRAK shall also collect a data about the access to the SITE by the browser.

1. PERSONAL DATA COLLECTION METHOD
1. 4.1.Automatically Collected Data: When the USER actually visits the site, personal data is automatically collected through first and third party cookies.
2. 4.2.Data shared by the USER: Personal data can be collected with form filling method and approval/acceptance mechanisms when the USER logs in manually.

1. THIRD PARTIES THAT COLLECT PERSONAL DATA

When the USER actually visits the site, personal data can be automatically collected by third parties through third party cookies that are integrated to the site.

The personal data of the USER that are collected through cookies is regulated pursuant to the Cookie Policy.

1. OBJECTIVE AND LEGAL GROUND OF PROCESSING PERSONAL DATA

The objective of the personal data that is processed within the scope of the site and its legal grounds are notified to the USER in information documents that are given in the data entry points.

1. TRANSFERRING THE PERSONAL DATA

The personal data that is processed by ANKA TOPRAK through the site can be transferred to shareholders, direct or indirect subsidiaries, persons who sell services or are cooperated with, courthouses and law enforcement bodies as well as public authorities that are authorized to request the data pursuant to their authorizations.

When the personal data is transferred, the major principles that are mentioned in the Law for the transfer are taken into consideration.

1. STORAGE SAFETY AND SECURITY OF PERSONAL DATA

Necessary technical and administrative measures are taken to protect the places where the personal data, which is processed within the scope of the site pursuant to  the Article 12 of the Law, is stored to prevent the illegal processing of the data, eliminate access by unauthorized persons, and protect integrity thereof.

If a data violation occurs, necessary actions are taken, and the Personal Data Protection Committee is informed pursuant to the legal requirement.

1. LINKS TO OTHER SITES

This policy, hereby, applies only to the SITE. The site contains the links that refer the user to web sites under control of third parties, and this confidentiality policy does not apply to the web sites that the user is referred to by the site. In this context, ANKA TOPRAK does not assume any confidentiality condition of those sites.

1. RIGHTS OF THE DATA SUBJECTS

The USER, who is a “data subject” within the scope of the Law, has following rights pursuant to the Article 11 of the Law.

1. Learn whether personal data is processed or not,
2. Request relevant information, if personal data is processed,
3. Learn the intent of processing personal data and whether they are used in accordance with the intent,
4. Learn local and international third parties that are transferred the personal data,
5. Request correction, if the personal data are processed incompletely or incorrectly,
6. Request to have your personal data deleted or disposed/destroyed pursuant to the provisions of the Article 7,
7. Request notification of the third parties that received the data about the procedures performed pursuant to sub-clauses (d) and (e).
8. Raise an objection to a negative outcome arising out of analyzing the data exclusively with automated systems,
9. Request compensation of losses and damages that arise out of illegal processing of personal data.

The USER can use above mentioned rights by contacting ANKA TOPRAK over the communication means mentioned in the Article 12 of the Policy.

ANKA TOPRAK shall respond to the USER within 30 days after the request is received.

1. CONTACT DETAILS

USERS can notify a request to ANKA TOPRAK in terms of the use of the rights by the “data subject”:

1. Physically visiting our company at Güvenevler Mah Farabi Sok No 43 Çankaya/ANKARA or sending a letter with certified mail service,
2. Submitting your requests through notary offices in order to identify you, not to give incorrect information or not to inform an unauthorized person,
3. Sending an e-mail to kvkk@ankatoprak.com.tr using your e-mail address that was previously notified by you to our Company or that is also saved in our system,
4. Sending an e-mail to the KEP (registered e-mail) address, ankatoprak@hs06.kep.tr, of our company using your KEP (registered e-mail),
5. Using other procedures that are mentioned in relevant legislation by verifying your identity details.

1. VALIDITY AND AMENDMENT
1. 13.1.This Confidentiality Policy, hereby, shall be valid immediately after it is published in the SITE.
2. 13.2.ANKA TOPRAK can update the Confidentiality Policy, whenever it wants, to update the data protection policies and fulfill obligations of relevant legislation.
3. 13.3.The amended Confidentiality Policy is published at the web site of the Company. The amendments in the Confidentiality Policy shall be put into force when it is published in the SITE.
